CSMS# 17-000321 - Correct Use of Disclaim Codes for Pesticides under EPA PGA Message Set

On May 18, 2017, the Harmonized Tariff Schedule (HTS) flagging for all Environmental Protection Agency (EPA) programs went into effect pursuant to CSMS #17-000253.



A review of the disclaim codes submitted since May 18, 2017 indicate that filers are having some difficulty filing the correct disclaim codes for EPA Pesticides. In order to assist trade in completing disclaims correctly for EPA, please note the correct use:



A = product is not regulated by this agency – Indicates the product does not require a Pesticide Notice of Arrival.

B = [code is NOT allowed for EPA Pesticides] – Please do not file a disclaim code B for pesticides.

C = data filed through other agency means - If disclaim “C” is provided for EPA Pesticides, an image of an EPA-signed Notice of Arrival must be provided in DIS for this Entry Number. If an EPA-signed NOA is not provided, it is a violation. If you meant to file a code A rather than C you can use the CA transaction to submit the corrected information.

D = data filed through paper – If disclaim “D” is provided for EPA Pesticides, an EPA-signed copy of the Notice of Arrival must accompany the shipment.
