Trade is reminded that for commodities subject to the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) import requirements, they must either provide a Pesticide Notice of Arrival (NOA) signed by the Environmental Protection Agency (EPA) or submit the same information and an on-product label with the entry information via ACE prior to arrival at the port of entry.



EPA has put out guidance to trade (see CSMS #17-000288) regarding filing such data. You may provide EPA-signed NOAs one of two ways; (1) Select disclaim code C in the PGA message set and upload a scanned image of the paper EPA-signed NOA to DIS, or (2) select disclaim code D in the PGA message set and provide the paper EPA-signed NOA with the shipment.



Beginning August 1, 2017, if trade provides disclaim codes C or D for commodities subject to FIFRA import requirements, ACE will automatically send an SO70 message to trade that indicates that EPA has put a “Documents Required” on that entry, to signify ‘additional information required’. The entry will remain in Document Required status until CBP can verify that the required documentation (an EPA-signed NOA) has been provided in DIS or is accompanying the shipment.



NOTE: In these instances (EPA Pesticides with disclaim codes C or D), trade could receive two SO70 messages from CBP. This is because PGA data is evaluated in parallel with CBP data. If CBP data is clean, an SO with a release could be sent, followed by an SO suspending release with an EPA docs required.
