DRAFT EUROPEAN PARLIAMENT LEGISLATIVE RESOLUTION

on the Council position at first reading with a view to the adoption of a regulation of the European Parliament and of the Council establishing the Citizens, Equality, Rights and Values Programme and repealing Regulation (EU) No 1381/2013 of the European Parliament and of the Council and Council Regulation (EU) No 390/2014

The European Parliament,

 having regard to the Council position at first reading (06833/1/2020– C9‑0144/2021),

 having regard to the opinion of the European Economic and Social Committee of 18 October 2018[1],

 having regard to the opinion of the Committee of the Regions of 10 October 2018[2],

 having regard to its position at first reading[3] on the Commission proposal to Parliament and the Council (COM(2018)0383),

 having regard to Article 294(7) of the Treaty on the Functioning of the European Union,

 having regard to the provisional agreement approved by the committee responsible under Rule 74(4) of its Rules of Procedure,

 having regard to Rule 67 of its Rules of Procedure,

 having regard to the recommendation for second reading of the Committee on Civil Liberties, Justice and Home Affairs (A9-0144/2021),

1. Approves the Council position at first reading;

2. Approves the joint declaration by Parliament and the Council annexed to this resolution;

3. Notes that the act is adopted in accordance with the Council position;

4. Instruct its President to sign the act with the President of the Council, in accordance with Article 297(1) of the Treaty on the Functioning of the European Union;

5. Instructs its Secretary-General to sign the act, once it has been verified that all the procedures have been duly completed, and, in agreement with the Secretary-General of the Council, to arrange for its publication, together with joint declaration of the European Parliament and the Council thereon, in the Official Journal of the European Union;

6. Instructs its President to forward its position to the Council, the Commission and the national parliaments.


 

SHORT JUSTIFICATION

The Citizens, Equality, Rights and Values Programme groups together two previous  funding programmes, the Rights, Equality and Citizenship Programme and Europe for Citizens programme. The general objective of the programme is to protect and promote the rights and values enshrined in the Treaties and the Charter of Fundamental Rights.

One of the major achievements in the negotiations was the inclusion of an “Union values strand”, among the specific objectives of the Programme. By promoting rights and values, the Programme will contribute to the construction of a more democratic and inclusive Union, promote equality and respect for the rule of law and democratic dialogue, transparency and good governance, including by supporting civil society organizations. Also the strands referring to Equality, Rights and Gender Equality, to Citizens' engagement and participation and to fighting all forms of violence, in particular gender-based violence (Daphne) contain enhanced provisions that will ensure that adequate support will be provided to civil society acting in these fields. Moreover appropriate funding, including from the additional allocation, was indicated with clear amounts by specific objectives. In the negotiations the co-legislators also agreed on a joint declaration that states that the Union Values strand of this Programme should be equipped with substantial funding from 1 January 2021.

On this file interinstitutional negotiations were concluded on 17 December 2020. The outcome of negotiations was endorsed at COREPER level on 3 February 2020 and a confirmation vote was held at LIBE committee level on 4 February 2021. Since the Council’s first reading position adopted on 19 April 2021 fully reflects the agreement reached in early second reading, the recommendation for the second reading is to approve the Council position.


ANNEX

Joint declaration of the European Parliament and the Council on financing the Union values strand in 2021

 

Without prejudice to the powers of the budgetary authority, the co-legislators agree that the Union Values strand of the Citizenship, Equality, Rights and Values programme should be equipped with substantial funding from the 1st of January 2021.

The co-legislators call upon the Commission to take appropriate actions to reach that objective, especially to assess the use of flexibility instruments under the legal framework of the annual EU budget for 2021, in accordance with the activation criteria laid down in the MFF regulation.
