Request for Comment on Proposed Changes to the Local Rules

The judges invite comment to proposed changes to the local rules to scbml_lr_comment@scb.uscourts.gov on or before November 10, 2022.  All local rules were revised to remove the notes regarding amendment history that date prior to 2017.  The Court’s website will provide links to both the local rules with the full history as well as the condensed version.  Because these revisions involved numerous rules and did not change the language of the rules, they are not included in the attached redline copy. 
Additional rule changes are as follows:



  • Rule 1007-3 – amended to remove portions incorporated into Fed. R. Bankr. P. 1007

  • Rules 1020-1, 2009-1, 2012-1, 2015-1, 3010-1, 3011-2, 3014-1, 3017.1-1, 3017.2-1, 3018-2, and 3019-1 – removed interim rules that will be incorporated into the Federal Rules, effective December 1, 2022

  • Rule 2016-1 – amended to clarify that supplemental attorney's fees paid directly by the debtor to the attorney must be disclosed on the docket

  • Rule 3015-1 – amended to incorporate the treatment of conduit plans provided in Operating Order 22-03 

  • Rule 3016-1 – amended distinguish cases under subchapter V of Chapter 11 and incorporate portions of Chambers Guidelines requiring a redline version of a modified disclosure statement

  • Rule 5005-4 – amended to incorporate provisions of Operating Orders 21-02 and 22-02 for filing documents on CM/ECF and filings by pro se individuals

  • Rule 5080-1 – amended to incorporate provisions of Operating Order 22-02 for payment of filing fees by pro se individuals

  • Rule 7001-1 – amended to include procedure prior to issuance of a scheduling order 

  • Rule 9011-4 – amended to incorporate provisions of Operating Order 22-02 regarding signatures for filings by pro se individuals

  • Rule 9013-2 – amended to incorporate provisions of Chambers Guidelines for notifying court staff of certain contested matters 

  • Rule 9013-4 – amended to clarify that hearings are to be held in the case's division and before the assigned judge unless otherwise allowed by Chambers Guidelines or after consultation with court staff 

  • Exhibits to Rule 9013-4 – amended to move applications for compensation to Exhibit B for non-passive notice 

  • Rule 9037-1 – amended to remove information duplicative of Fed. R. Bankr. P. 9037

  • Rule 9070-1 – amended to incorporate provisions of Chambers Guidelines for exhibit procedures

In the absence of negative public comment and withdrawal or revision by the judges, these rules will be effective December 1, 2022.  The judges would like to thank the Local Rules Committee for their assistance.
