DHS seeks public comment on proposed spending plan for increased federal HCBS funds

The Minnesota Department of Human Services invites input from stakeholders and the public on Minnesota’s proposed spending plan for increased federal funds to enhance, expand and strengthen our home and community-based services (HCBS) for people with disabilities and the elderly.

Section 9817 of the recently enacted American Rescue Plan provides states with a one-year 10% increase in the federal medical assistance percentage (FMAP) for certain home and community-based services funded under Medicaid. The enhanced FMAP applies to allowable expenditures for services provided between April 1, 2021, and March 31, 2022. States must use state funds equivalent to the amount of federal funds attributable to the increased FMAP to implement or supplement the implementation of activities to enhance, expand and strengthen HCBS under the Medicaid program. These state funds must be spent by March 31, 2024.

The Minnesota Legislature has authorized approximately $685 million in spending to implement a range of activities that enhance, expand and strengthen HCBS. These activities are categorized as follows:

  • · Increasing provider rates to enhance, expand and strengthen access to HCBS
  • · Expanding services available under HCBS
  • · Supporting people who receive HCBS to live in their own homes
  • · Planning and implementing reforms to expand, enhance and strengthen the Medicaid HCBS service system
  • · Supporting and strengthening the infrastructure for HCBS in Minnesota.
  • For details of the authorized activities, see HCBS FMAP Funded Proposals (PDF). Minnesota must submit this spending plan to the Centers for Medicare & Medicaid Services (CMS) for approval. State law requires DHS to consult with stakeholders before submitting the spending plan to CMS. See Laws of Minnesota 2021, First Special Session, chapter 7, article 17, section 21. Comments on this spending plan may be submitted via e-mail to osw.smd.dhs@state.mn.us. The deadline to submit comments is Aug. 12, 2021.
