Proposed Part 350 Regulations Now Open for Public Comment

DEC filed a Notice of Proposed Rulemaking with the Department of State to add a new 6 NYCRR Part 350. The proposed regulations will implement the requirements outlined in the NYS Food Donation and Food Scraps Recycling Law enacted in 2019. The law takes effect on January 1, 2022 and requires large generators of food scraps to donate excess edible food and recycle all remaining food scraps if they are located within 25 miles of an organics recycler.

The Notice of Proposed Rulemaking is available in the January 27, 2021 issue of the State Register. Written public comments will be accepted by the NYSDEC through April 27, 2021.

Persons wishing to comment on the proposed regulations have the opportunity to submit written comments or make a statement at one of two public comment hearing webinars. The first session will begin at 1:00 p.m. on Wednesday, April 7, 2021. The second session will begin at 6:00 p.m. on Wednesday, April 7, 2021.

DEC Grants for Household Hazardous Waste Programs

The Department of Environmental Conservation announced that funding from the Environmental Protection Fund is available for grants to assist municipalities in New York State with costs associated with household hazardous waste (HHW) collection and disposal. Grants are offered to match eligible costs of HHW collection days or construction of permanent HHW collection facilities to provide a safe alternative for recycling or disposal of household hazardous materials.

State funding will reimburse up to 50 percent of the costs of municipal HHW collection programs. DEC will be accepting applications only during January and February of 2021 for projects that were completed during January - December 2020.

Applications must be submitted in the Grants Gateway no later than 3 p.m. on Friday, February 26, 2021.
