  • The following are summaries and other information related to Proposed Rules that the Missouri Department of Natural Resources has submitted to the Secretary of State for Publication in the Missouri Register. These rules will not go into effect until the public has had an opportunity to submit written comments, and to attend a public hearing if one is scheduled.

    Any person may offer comments on a Proposed Rule. The instructions for submitting comments, and the location and date of a hearing if one is scheduled, are located after the text of each rule. Please note that the official text of a Proposed Rule is the version that appears in the Missouri Register, not the draft copy on this site.

    Information on Rules in Initial Development follows the Proposed Rules information. The dates provided in this section are subject to change.

    The purpose of this rulemaking is to improve clarity and correct errors in definitions for apprentice, augered well, domestic well, multifamily well, state of disrepair, and temporary monitoring well. This rulemaking also removes unnecessary definitions of non-transient non-community and transient non-community. These changes are necessary to ensure the proper meaning of definitions used in regulations and to remove confusion and inconsistencies in rule language.

    The purpose of this rulemaking is to remove the requirement that permittees carry a physical vehicle registration card in each registered vehicle and/or machine. This rulemaking is necessary to remove an unneeded burden for permittees and will streamline the vehicle/machine registration process.

    The purpose of this rulemaking is to correctly incorporate by reference certain ASTM standards, improve rule clarity, correct erroneous data in Table 3.5, and add flexibilities to water well construction requirements. These changes are necessary to properly incorporate reference material pursuant to Chapter 536, RSMo, to ensure clarity, and to remove unnecessary restrictions related to drilling materials.

    The purpose of this rulemaking is to remove unnecessary language, improve rule clarity, and insert language to address the protection of inactive wells that is being modified and moved from 10 CSR 23-3.110. The rulemaking is necessary to remove overly burdensome requirements for well owners and the drilling industry.

    The purpose of this rulemaking is to adjust the minimum depth to the top of a liner in a water well from 10 feet below ground surface to 20 feet below ground surface. This rulemaking is necessary to remove an overly burdensome regulation that provides no additional well construction or groundwater protection benefit.

    10 CSR 23-3.090
    The purpose of this rulemaking is to improve rule clarity and remove overly burdensome requirements regarding well construction materials and grouting requirements for wells outside of impact areas in Drilling Area 11. This rulemaking also removes the use of liners as a substitute for casing to construct Area 11 lower aquifer wells within Impact Areas and reduces monitoring requirements for TCE and its degradation products.     The purpose of this rulemaking is to properly incorporate references into the rule (i.e., ASTM Standards), remove unnecessary language, improve rule clarity, remove pre-notification requirements for grouting geothermal wells less than 200 feet in depth that are not grouted full-length, and add tracer wire requirements. The rulemaking is necessary to comply with the administrative requirements for rules under Chapter 536, RSMo, and to incorporate tracer wire requirements per the approval of the Well Installation Board.
