Summary/Background (Key Points)

In November 2021, the School Board Governance Committee, in collaboration with FCPS Division Counsel, developed an initial draft of a Trust Policy, to align with the Fairfax County Trust and Confidentiality Policy, with the goal of ensuring FCPS families feel comfortable that their personal information will not be shared with immigration officials. Since that time, the draft policy has been revised and updated through the Governance Committee processes, and has been assigned to the Office of Professional Learning and Family Engagement, to align with Strategic Plan Goal #2-Caring Culture.

Recommendation:

That the Board approves the Trust Policy.

 

Board Member proposed follow-on motion.

1.  I move to direct the Superintendent to implement as much of the School Trust Policy as possible for the 2022 summer school session and conduct all necessary preparations for the policy to be fully implemented for the start of the 2022-2023 school year. (KF/RA)

 

2. I move to direct the Superintendent to:

  • By mid-July August, provide guidelines for the Department of Human Resources to promote compliance with this policy, including investigative procedures and potential disciplinary actions for the unauthorized sharing of personally identifiable information and citizenship or immigration status.
  • By May 10, provide the Board with updated language to the “Rights and Responsibilities of Students” section of the draft SR&R, that states students have an unambiguous right to have their personally identifiable information and citizenship or immigration status protected from unauthorized sharing.
  • Beginning in mid- July August, provide regular written updates to the Board and public regarding noncompliance with this policy, progress on communications to students and families as outlined in this policy to include information about what is and is not covered/protected, and other pertinent information as needed.
