Refrigerated Beverage Vending Machines

As defined in the Code of Federal Regulations (CFR), “refrigerated bottled or canned beverage vending machine” means a commercial refrigerator (as defined at §431.62) that cools bottled or canned beverages and dispenses the bottled or canned beverages on payment. 10 CFR 431.292 Manufacturers have been required to comply with the U.S. Department of Energy (DOE) energy conservation standards for refrigerated beverage vending machines since 2012.

Recent and Ongoing Activities

DOE has published a Federal Register notice amending the test procedures for refrigerated bottled or canned beverage vending machines (BVMs) to reference the latest version of the industry standard, while maintaining certain provisions specified in the current DOE test procedure. DOE also provides setup instructions for non-beverage shelves, updates the lowest application product temperature definition and test instructions, specifies setup instructions for refrigeration leak mitigation controls, and removes the obsolete test procedure.

  • The effective date of this rule is June 5, 2023.
  • The amendments will be mandatory for equipment testing starting October 31, 2023.
  • The incorporation by reference of certain materials listed in the rule is approved by the Director of the Federal Register June 5, 2023.

Current Standard

Refrigerated beverage vending machines manufactured and distributed in commerce, as defined by 42 U.S.C. 6291(16), must meet the energy conservation standards specified in the Code of Federal Regulations at 10 CFR 431.296.


Current Test Procedure

To determine that refrigerated beverage vending machines that are currently manufactured or distributed into commerce are in compliance with DOE standards, manufacturers must follow the test procedure methods specified at 10 CFR 431.294.

State Exemptions to Federal Pre-emption

DOE has not exempted any state from this energy conservation standard. States may petition DOE to exempt a state regulation from preemption by the Federal energy conservation standard. States may also petition DOE to withdraw such exemptions. For details, see 10 CFR part 430, subpart D.
