Workplace rights

The state’s Wage Payment Act provides basic workplace rights for you as an employee. It also provides a way to file a workplace rights complaint if you believe your rights have been violated.

Claim suppression

Your employer cannot prevent you from filing a workers' compensation claim. If an employer prevents you from filing a workers' compensation claim for a legitimate workplace injury it can be considered a form of claim suppression.

Workers' compensation discrimination

Your employer may not discriminate or retaliate against you for filing a workers' compensation claim.

Revealing of mental health conditions and treatment

Your employer has the right to access your claim file, including mental health information.  An employer can only reveal your mental health condition(s) or treatment to people who are authorized to access the information. If you believe your confidential mental health information has been shared with unauthorized people, please let us know at www.Lni.wa.gov/MentalHealthPrivacyWorkers

Injured worker fraud

Injured worker fraud can be considered a person who receives workers' compensation benefits but appears able to work; is working while collecting time loss; was not injured, working while collecting benefits, or was not injured on the job are just a few examples.

Provider billing fraud

If you suspect a health care provider is billing inappropriately, for example: billing for services not provided, misrepresenting dates, location, or who provided the services this may be considered provider billing fraud.

If you suspect a provider is billing inappropriately. Please download and fill out the Health Care Provider Fraud form, then email the form as an attachment to ProviderFraud@Lni.wa.gov.

Adjustment in penalties for inflation

RCW 51.48.095 – Adjustment for inflation.

Penalties payable pursuant to this chapter shall be adjusted for inflation every three years, beginning July 1, 2023, based upon changes in the consumer price index during that time period.

Impacts: RCW 51.48.080 and RCW 51.48.250.
