    Summary: There was fault by the Council in the annual review of Mr Y’s Education, Health and Care Plan and a delay in issuing a final plan following the review. This caused avoidable distress, time and trouble and a loss of education. The Council will apologise and make payments in this statement.

    Summary: The Council avoidably delayed by six months in finalising Mr X’s child, Z’s, Education Health and Care Plan (EHC Plan). This delayed Mr X’s right of appeal to the Special Educational Needs and Disabilities (SEND) Tribunal. The Council also delayed in putting tutoring provision in place for Z which led to Z missing one month of education. The Council has agreed to pay Mr X £500 in recognition of the frustration and uncertainty caused by these faults. We find the Council not at fault in how it produced a draft, amended EHC Plan, nor for allocating several different key workers for Z as this was due to staff absence.

    Summary: Miss X complained about the Council’s delay in providing a draft of her son’s Education, Health and Care Plan following annual review. We found the Council took too long to send the paperwork to the family. Miss X and her son suffered avoidable frustration and distress due to the wait. To remedy the injustice caused by this fault, the Council has agreed to apologise and make a payment to Miss X to acknowledge the distress caused.

    Summary: Dr X complained about the Council’s delay in the Education, Health and Care Plan annual review process for her daughter. She also complained her daughter was on a long term part-time timetable at school, which is against the Council’s policy. We found there was fault by the Council significantly delaying issuing a decision letter after the annual review. There was also fault for not taking action to consider or provide full-time education for Dr X’s daughter, and fulfilling its duties under the Equality Act 2010. The Council has agreed to our recommendations to remedy the injustice and to take action to prevent recurrence of fault identified.

We find the Council was at fault as it delayed securing the provision. The Council has agreed to our recommendations to address the injustice caused by fault.

    Summary: the Ombudsman cannot investigate Ms P’s complaints about the lack of education for B or the Council’s failure to identify a suitable special school for him because Ms P has appealed to the First Tier Tribunal. The Council has apologised for the uncertainty caused and the problems Ms P experienced dealing with the Special Educational Needs Service. This is a satisfactory remedy.

    Summary: We will not investigate Mrs X’s complaint about the Education Health and Care Plan process. This is because much of the complaint is late and there were appeal rights available. Mrs X has now used her right of appeal. This places a further period complained about outside the Ombudsman’s jurisdiction. It is reasonable for Mrs X to submit a further appeal if she wants to challenge the content of her son’s Education Health and Care Plan. We have no powers to consider complaints about what happens in schools.
