1. Resumption of the session

The session suspended on Thursday 21 January 2021 was resumed.


2. Opening of the sitting

The sitting opened at 17.04.


3. Approval of the minutes of the previous sittings

The minutes of the sittings of 18, 19, 20 and 21 January 2021 were approved.


4. Composition of Parliament

The Belgian authorities had given notice of the election of Tom Vandenkendelaere to replace Kris Peeters as Member of Parliament with effect from 25 January 2021.

The Swedish authorities had given notice of the election of Emma Wiesner to replace Fredrick Federley as Member of Parliament with effect from 4 February 2021.

Parliament took due note of their election.

Under Rule 3(2), until such time as their credentials had been verified or a ruling had been given on any dispute, and provided that they had previously made a written declaration stating that they did not hold any office incompatible with that of Member of the European Parliament, Tom Vandenkendelaere and Emma Wiesner would take their seats in Parliament and on its bodies and would enjoy all the rights attaching thereto.


5. Composition of committees and delegations

The President had received from the PPE, Renew and ID groups the following decisions changing the composition of the committees and delegations:

6. Negotiations ahead of the Council’s first reading (Rule 72)

The President announced that the ECON Committee had decided to enter into interinstitutional negotiations, in accordance with Rule 72, on the basis of Parliament’s following position at first reading:

- European Parliament legislative resolution of 17 April 2019 on the proposal for a regulation of the European Parliament and of the Council establishing the ‘Fiscalis’ programme for cooperation in the field of taxation (COM(2018)0443 – C8-0260/2018 – 2018/0233(COD)) – position at first reading P8_TA(2019)0404.

The position adopted by Parliament at first reading constituted the mandate for the negotiations.


7. Delegated acts and implementing measures (Rule 111(6) and Rule 112(4)(d))

The President announced that the Chair of the Conference of Committee Chairs had made it known that no objections had been raised to:

- the ECON Committee recommendation to raise no objections to the draft Commission regulation amending Regulations (EU) 2019/424, (EU) 2019/1781, (EU) 2019/2019, (EU) 2019/2020, (EU) 2019/2021, (EU) 2019/2022, (EU) 2019/2023 and (EU) 2019/2024 with regard to ecodesign requirements for servers and data storage products, electric motors and variable speed drives, refrigerating appliances, light sources and separate control gears, electronic displays, household dishwashers, household washing machines and household washer-dryers and refrigerating appliances with a direct sales function (D069494/02 - 2020/2917(RPS)) (B9-0107/2021);

- the AGRI Committee recommendation to raise no objections to the Commission delegated regulation of 19 January 2021 amending Annex I to Regulation (EU) No 1305/2013 of the European Parliament and of the Council as regards the amounts of Union support for rural development in the year 2021 (C(2021)00188 - 2021/2517(DEA)) (B9-0110/2021);

- the AGRI Committee recommendation to raise no objections to the Commission delegated regulation of 27 January 2021 amending Delegated Regulation (EU) 2020/884 derogating in respect of the year 2020 from Delegated Regulation (EU) 2017/891 as regards the fruit and vegetables sector and from Delegated Regulation (EU) 2016/1149 as regards the wine sector in connection with the COVID-19 pandemic, and amending Delegated Regulation (EU) 2016/1149 (C(2021)00371 - 2021/2530(DEA)) (B9-0111/2021);

- the ECON Committee recommendation to raise no objections to the Commission delegated regulation of 21 December 2020 amending technical standards laid down in Delegated Regulation (EU) 2016/2251 as regards to the timing of when certain risk management procedures will start to apply for the purpose of the exchange of collateral (C(2020)09147 - 2020/2942(DEA)) (B9-0098/2021);

- the ECON Committee recommendation to raise no objections to the Commission delegated regulation of 21 December 2020 amending regulatory technical standards laid down in Delegated Regulations (EU) 2015/2205, (EU) 2016/592 and (EU) 2016/1178 as regards the date at which the clearing obligation takes effect for certain types of contracts (C(2020)09148 - 2020/2943(DEA)) (B9-0097/2021).

If no objection was expressed by a political group or a number of Members reaching at least the low threshold within 24 hours, the recommendations would be deemed approved after announcement in plenary. If such an objection were forthcoming, they would be put to the vote.


8. Signing of acts adopted in accordance with the ordinary legislative procedure (Rule 79)

The President announced that on Wednesday 10 February 2021, jointly with the President of the Council, he would sign the following acts adopted under the ordinary legislative procedure:

- Regulation of the European Parliament and of the Council amending Regulation (EU) No 654/2014 concerning the exercise of the Union’s rights for the application and enforcement of international trade rules (00052/2020/LEX - C9-0015/2021 - 2019/0273(COD));

- Regulation of the European Parliament and of the Council establishing a Technical Support Instrument (00061/2020/LEX - C9-0014/2021 - 2020/0103(COD));

- Regulation of the European Parliament and of the Council amending Regulation (EU) 2016/1011 as regards the exemption of certain third-country spot foreign exchange benchmarks and the designation of replacements for certain benchmarks in cessation, and amending Regulation (EU) No 648/2012 (00063/2020/LEX - C9-0013/2021 - 2020/0154(COD));

The final draft agenda for the February 2021 (PE 679.108/PDOJ) sittings had been distributed and the following changes had been proposed (Rule 158):

The President informed the House that he had received two requests for urgent procedure under Rule 163 for the adoption of the following files during the part-session:

- Slot utilisation rules at Union airports: temporary relief (Item 63 on the final draft agenda);

- Temporary measures concerning the validity of certificates and licences (Omnibus II) (Item 64 on the final draft agenda).

The President announced that the requests would be put to the vote at that day’s voting session.

The President pointed out that the votes would be spread over the various voting sessions depending on the number of amendments and requests for split and separate votes. Information on the manner in which the votes would be spread over the various voting sessions was available on Parliament’s website under ‘Priority information and documents’.

Parliament agreed to the proposals.

The order of business was thus established.
