Arizona Window Installation Company to Pay $577,997 To Employees After U.S. Department of Labor Finds Overtime Violations

PHOENIX, AZ After an investigation by the U.S. Department of Labor’s Wage and Hour Division (WHD) Southwest Windows & Doors LLC – based in Tempe, Arizona – will pay $577,997 to 109 employees for violations of the Fair Labor Standards Act’s (FLSA) overtime requirements.   

WHD found the window installation company – which does business as Renewal by Anderson – failed to pay overtime to employees paid on a piece-rate basis when they worked more than 40 hours in a work week. Southwest Windows & Doors LLC also failed to maintain complete and accurate records of all the hours employees actually worked, as required.

“Employers must pay their employees all the wages they have legally earned for their work,” said Wage and Hour District Director Eric Murray in Phoenix, Arizona. “Even when employers pay workers on a per-unit basis, they still must track the hours those employees work, and pay overtime when they exceed 40 in a workweek. We encourage employers and employees to call us for assistance to improve their understanding of the labor standards and learn about our on-line educational tools to avoid violations like those found in this investigation.”

The department offers numerous resources to ensure employers have the tools they need to understand their responsibilities and to comply with federal law, such as online videos, confidential calls, or in-person visits to local WHD offices.
