The following rule actions were filed with the Texas Register for publication in the March 26, 2021 issue:

Proposed Amendment to 19 TAC Chapter 61, School Districts, Subchapter CC, Commissioner's Rules Concerning School Facilities, §61.1037, Science Laboratory Grant Program
Summary: The proposed amendment would update a reference to statute that was recodified by House Bill 3, 86th Texas Legislature, 2019, and update references to administrative rules on school facilities standards in order to be more encompassing.
Publication in the Texas Register: March 26, 2021
Public Comment Period: March 26, 2021-April 26, 2021. A form for submitting public comments is available on the proposed commissioner of education rules web page.
Proposed Effective Date: June 29, 2021

Adopted Amendment to 19 TAC Chapter 61, School Districts, Subchapter AA, Commissioner's Rules on School Finance, §61.1010, Additional State Aid for School Districts that Contract to Partner to Operate a District Campus

Summary: The adopted amendment reflects changes made by Senate Bill 2117 and House Bill 3, 86th Texas Legislature, 2019, and revises the list of allotments to be excluded from the entitlement. The amendment was adopted without changes since published as proposed.

Effective Date: March 30, 2021

 

Adopted Amendment to 19 TAC Chapter 101, Assessment, Subchapter DD, Commissioner's Rules Concerning Substitute Assessments for Graduation, §101.4002, State of Texas Assessments of Academic Readiness End-of-Course Substitute Assessments

Summary: The adopted amendment adds the new Texas Success Initiative Assessment, Version 2.0 to the list of approved substitute assessments. The amendment and figure were adopted without changes since published as proposed.

Commissioner of Education Rule Review

 

The following rule review notice was filed with the Texas Register for publication in the March 26, 2021 issue:

 

Adopted Review of 19 TAC Chapter 30. The Texas Education Agency (TEA) adopts the review of 19 TAC Chapter 30, Administration, Subchapter AA, Commissioner of Education: General Provisions, and Subchapter BB, Commissioner of Education: Purchasing and Contracts, pursuant to Texas Government Code, §2001.039.

Summary: TEA finds that the reasons for adopting Subchapters AA and BB continue to exist and readopts the rules. TEA did not receive any comments related to the review. At a later date, TEA anticipates proposing an amendment to Subchapter AA that would update the procedures to petition for the adoption of rule changes.
