 Summary/Background (Key Points):

 

The Department of Special Services (DSS) has completed the Local Special Education Annual Plan/Part B Flow-Through Application and Report for the 2022-2023 school year, as required by Public Law 108-446, the Individuals with Disabilities Education Improvement Act of 2004 (IDEA), and the Virginia Department of Education (VDOE) State Superintendent's Memo #319-21, dated December 3, 2021. This report will be used by VDOE in preparing the state plan for special education. As required by VDOE, this report has been prepared and will be submitted entirely online in a VDOE-prescribed abbreviated format on a date, no later than May 13, 2022.

 

The 2022-2023 Section 611, Part B application estimates revenue to Fairfax County Public Schools (FCPS) of $37,845,107. This amount projects a 2022-2023 award amount equal to the final IDEA Part B, Section 611 Flow-Through allocation that FCPS received for Federal Fiscal Year (FFY) 2022, as communicated in the VDOE Superintendent’s Memo #198-21 dated July 23, 2021Estimated Section 611 expenditures include costs associated with the voluntary 15 percent set-aside for Coordinated Early Intervening Services (CEIS); a mandatory proportionate set-aside, which ensures that FCPS spends a proportionate share of funds on special education services for parentally-placed private school children with disabilities; materials and supplies; and state restricted indirect costs of 1.0 percent. The IDEA Section 611 Part B, award will fund a total of 295.60 FTE positions.

 

The 2022-2023 Section 619, Part B Preschool application estimates revenue to FCPS of $842,851. This amount projects a 2022-2023 award amount equal to the final IDEA Part B, Section 619 Flow-Through allocation that FCPS received for Federal Fiscal Year (FFY) 2022, as communicated in the VDOE Superintendent’s Memo #198-21 dated July 23, 2021.These funds support Child Find activities as well as parenting and transition services for preschool-age students. Estimated expenditures include costs associated with a mandatory proportionate set-aside and state restricted indirect costs of 1.0 percent. The IDEA Section 619 (Preschool), award will fund 6.0 FTE positions.

 

The 2022-2023 application reflects estimated costs for the current programs funded in the 2021-2022 application. Small adjustments in both sections 611 and 619 have been made for incumbent salaries, employee benefit costs, and materials and supplies. The plan projects a state restricted indirect cost rate of 1.0 percent, consistent with the rate for FY 2022.

 

The 2022-2023 Annual Plan was presented to the Fairfax County Advisory Committee for Students with Disabilities (ACSD) at the March 9, 2022 meeting.

 

Recommendation: It is recommended that the School Board approve the 2022-2023 Local Special Education Annual Plan/Part B Flow-Through Application and Report, Section 611, Part B grant funding application and Section 619, Part B Preschool grant funding application, as detailed in the agenda item.
