Summary: We cannot investigate Mr X’s complaint about the actions of social workers. These matters are not separable from matters that were or could have been raised during court action.

The complaint

  1. Mr X said the Council had apologised for the complications he had faced to understand his position on getting explanations, information, and insight into his missing children. He wanted the Council to provide him with the information it had withheld.

  2. We cannot investigate a complaint if someone has started court action about the matter. (Local Government Act 1974, section 26(6)(c), as amended)

My assessment

  1. The complaint correspondence Mr X provided gave details of court action he took to secure contact with his children. We cannot investigate matters that are not separable from court action. It would have been reasonable for Mr X to raise the issue of the Council denying him information about his children’s whereabouts in court.
