National criteria regarding European Public Prosecutor’s Office prosecutors and delegate prosecutors
14.4.2021
Question for written answer E-002016/2021
to the Commission
Rule 138
Sophia in 't Veld (Renew)
Prosecutors in the European Public Prosecutor’s Office (EPPO) must be strictly independent. In this respect, concerns have been raised about the legislative amendment that has recently been adopted at the proposal of the Slovenian Government, setting requirements for linguistic skills that go beyond those of the EPPO itself.
This raises a question about the right of Member States to adopt criteria that deviate from the EPPO rules and might even risk interfering with the appointment procedure.
- 1.Does the Commission consider this amendment to be in line with the EPPO Regulation and are Member States entitled to set additional criteria for the selection and appointment of EPPO prosecutors and delegated prosecutors?
- 2.If not, will the Commission initiate an infringement procedure?
