DRAFT EUROPEAN PARLIAMENT LEGISLATIVE RESOLUTION
on the Council position at first reading in a view to the adoption of a regulation of the European Parliament and of the Council establishing the Justice Programme and repealing Regulation (EU) No 1382/2013

The European Parliament,
– having regard to the Council position at first reading (06834/1/2020 – C9-0138/2021),
– having regard to the opinion of the European Economic and Social Committee of 18 October 2018[1],
– after consulting the Committee of the Regions,
– having regard to its position at first reading[2] on the Commission proposal to Parliament and the Council (COM(2018)0384),
– having regard to Article 294(7) of the Treaty on the Functioning of the European Union,
– having regard to the provisional agreement approved by the committees responsible under Rule 74(4) of its Rules of Procedure,
– having regard to Rule 67 of its Rules of Procedure,
– having regard to the recommendation for second reading of the Committee on Legal Affairs and of the Committee on Civil Liberties, Justice and Home Affairs (A9-0146/2021),
1. Approves the Council position at first reading;
2. Notes that the act is adopted in accordance with the Council position;
3. Instructs its President to sign the act with the President of the Council, in accordance with Article 297(1) of the Treaty on the Functioning of the European Union;
4. Instructs its Secretary-General to sign the act, once it has been verified that all the procedures have been duly completed, and, in agreement with the Secretary-General of the Council, to arrange for its publication in the Official Journal of the European Union;
5. Instructs its President to forward its position to the Council, the Commission and the national parliaments.
SHORT JUSTIFICATION
On 30 May 2018, the European Commission submitted a proposal for a Regulation of the European Parliament and of the Council establishing the Justice programme. This programme has three main objectives:
- facilitating and supporting judicial cooperation in civil and criminal matters, promoting the rule of law, independence and impartiality of the judiciary;
- supporting and promoting judicial training, with a view to fostering a common legal, judicial and rule of law culture;
- facilitating effective and non-discriminatory access to justice for all, and effective redress, including by electronic means (e-justice).
The promotion of rule of law will benefit from a specific support, and the Commission will report annually on the performance of the Programme and the use of the funds for each specific objective, including actions linked to promotion of gender equality.
The European Parliament confirmed the common understanding reached with the Council on 17 April 2019, through the adoption of a legislative resolution (first reading).
The interinstitutional negotiations were concluded on 18 December 2020 and, at its meeting of 3 February 2021, the COREPER decided to accept the outcome of those negotiations. The Committee on Legal Affairs and the Committee on Civil Liberties, Justice and Home Affairs held a confirmation vote on the relevant compromise text on 4 February 2021.
Since the Council’s first reading position adopted on 19 April 2021 fully reflects the agreement reached in early second reading interinstitutional negotiations after legal linguistic verification, your rapporteurs recommend that it be endorsed by the European Parliament without amendments, so that the Regulation can be adopted swiftly and enter into force as soon as possible.
