Member States are responsible for the organisation of education systems, including the choice of language of instruction and the use of national and regional languages in education[1]. The Commission can therefore not pronounce itself on Constitutional provisions or national judicial decisions concerning these matters.

The Commission remains committed to upholding the rule of law in the EU, and is closely monitoring developments in Spain in the context of the Rule of Law Mechanism. On 30 September 2020, the Commission published the 2020 Rule of Law Report, which includes a dedicated country chapter for Spain[2].
