EXPLANATORY STATEMENT

Proposal for a regulation amending Regulation (EU) No 514/2014 refers to the implementation of the National Programs under the Asylum, Migration and Integration Fund (AMIF) and the Internal Security Fund (ISF) for the period of 2014-2020. Its objective is to ensure that in the face of the effects of the COVID-19 pandemic all Members States make full use of the N + 2 rule and have sufficient time for the implementation of the allocated funds and declaration of the expenditure to the Commission.

More specifically the aim is to guarantee that the decommitment rule (N+2) takes into account a payment request covering in full year N+2 submitted by Member States. In this regard, it is necessary to align the decommitment deadline with the deadline of the submission of the accounts.

In addition, in order to ensure consistency in the approach to decommitment and to provide Member States with an implementation period in line with the N+2 rule, it is proposed to align the decommitment of the additional allocations provided to the national programmes in 2018 and 2019 with the rules applicable to the basic allocation of the national programmes.

It is therefore proposed to amend Regulation (EU) No 514/2014 to ensure that all payment requests covering the year N+2 submitted by Member State within the regulatory deadlines set out in Article 44 of Regulation 514/2014 are taken into account when calculating the decommitment. In addition, it is proposed to amend Regulation (EU) No 514/2014 to ensure that the implementation period of the amounts corresponding to additional allocations to the national programmes provided in 2018 and 2019 is aligned with the implementation period of the initial allocation.

According to the Regulation in force the decommitment is taking place by 31 December of the second year following the year in which the given budget commitment was made. According to the new provision, the decommitment will take place by 15th February of the year following the second year in which the budget commitment was made. In short, the proposal will delay the deadline when the Commission determines the amount to be decommitted.

The unprecedented situation due to the COVID-19 pandemic in many cases has prevented the beneficiaries of the AMIF and ISF funds from full implementation the planned project.

Rapporteur believes therefore that the new proposal of the Commission will allow beneficiaries of internal affairs funds to complete interrupted activities and to eliminate delays in project implementation that have occurred due to the pandemic.
