DRAFT EUROPEAN PARLIAMENT LEGISLATIVE RESOLUTION

on the Council position at first reading with a view to the adoption of a regulation of the European Parliament and of the Council on a framework for the recovery and resolution of central counterparties and amending Regulations (EU) No 1095/2010, (EU) No 648/2012, (EU) No 600/2014, (EU) No 806/2014 and (EU) 2015/2365 and Directives 2002/47/EC, 2004/25/EC, 2007/36/EC, 2014/59/EU and (EU) 2017/1132

The European Parliament,

 having regard to the Council position at first reading (09644/1/2020 – C9‑0376/2020),

 having regard to the opinion of the European Economic and Social Committee of 29 March 2017[1],

 having regard to its position at first reading[2] on the Commission proposal to Parliament and the Council (COM(2016)0856),

 having regard to Article 294(7) of the Treaty on the Functioning of the European Union,

 having regard to the provisional agreement approved by the committee responsible under Rule 74(4) of its Rules of Procedure,

 having regard to Rule 67 of its Rules of Procedure,

 having regard to the recommendation for second reading of the Committee on Economic and Monetary Affairs (A9-0242/2020),

1. Approves the Council position at first reading;

2. Notes that the act is adopted in accordance with the Council position;

3. Instructs its President to sign the act with the President of the Council, in accordance with Article 297(1) of the Treaty on the Functioning of the European Union;

4. Instructs its President to forward its position to the Council, the Commission and the national parliaments.


 

SHORT JUSTIFICATION

The Council position at first reading reflects the agreement reached between Parliament and the Council in interinstitutional negotiations at early second reading stage, after legal-linguistic verification. Since the Committee on Economic and Monetary Affairs (ECON), at its vote from 2 September 2020, already confirmed the outcome of those interinstitutional negotiations, as your ECON co-rapporteurs we propose that ECON recommend that the Plenary confirms the position of the Council at first reading, without amending it.
