DRAFT EUROPEAN PARLIAMENT LEGISLATIVE RESOLUTION

on the proposal for a Council regulation amending Council Regulation (EU) No 389/2012 on administrative cooperation in the field of excise duties as regards the content of electronic registers (COM(2021)0028 – C9‑0016/2021 – 2021/0015(CNS))

 

(Special legislative procedure – consultation)

The European Parliament,

 having regard to the Commission proposal to the Council (COM(2021)0028),

 having regard to Article 113 of the Treaty on the Functioning of the European Union, pursuant to which the Council consulted Parliament (C9‑0016/2021),

 having regard to Rule 82 of its Rules of Procedure,

 having regard to the report of the Committee on Economic and Monetary Affairs (A9-0121/2021),

1. Approves the Commission proposal;

2. Calls on the Council to notify Parliament if it intends to depart from the text approved by Parliament;

3. Asks the Council to consult Parliament again if it intends to substantially amend the text approved by Parliament;

4. Instructs its President to forward its position to the Council, the Commission and the national parliaments.


 

EXPLANATORY STATEMENT

Council Regulation (EU) No 389/2012 lays down the legal basis for administrative cooperation between Member States.

Certified consignors and certified consignees are the economic operators involved in the movement of excise goods that have been released for consumption in the territory of one Member State and then moved to the territory of another Member State.

For a certified consignor or certified consignee sending or receiving excise goods only occasionally, Member States can give them a temporary certification limited to a specified quantity of excise goods, a single consignee or consignor and a specified period of time.

The proposal put forward by the Commission aims at amending the scope of Article 19 of Regulation (EU) No 389/2012 to include the information that Member States must introduce in the registers of the electronic database in relation to the certified consignors and certified consignees who are moving excise goods only occasionally and are granted a temporary certification.

This information concerns the quantity of goods, the identity of the economic operator at the end of the movement of the goods and the duration of the temporary certification.

In light of the technical nature of the proposal and the non-controversial content thereof, your rapporteur proposes that Parliament approves the proposal without amendments pursuant to a simplified procedure (rule 52).
